Noise regulations in Ibiza and Formentera

The obligation to install an acoustic limiter is not the same across the island. Each town hall triggers it for a different reason. Here it is, municipality by municipality, with the article and official source for each statement.

Who has authority over whom

Three regulatory levels overlap. The one that will compel you to take specific action —and the one that will penalize you— is the municipal one.

National

Five of the six municipalities require installing a limiter-logger, but each triggers it for a different reason: urban land use in Santa Eulària, tourist activity with music in Sant Josep, the type of activity in Sant Antoni and Formentera, and the class of establishment in Eivissa. The same business with two premises in two municipalities can have two different obligations.

For Sant Joan de Labritja we state "not verified" because we have not been able to read the full text of its ordinance. We prefer to say so rather than fill in the gap.

The three most costly mistakes

«I have the limiter, I'm already compliant»

No. The ordinances state it in these words: the installation of an acoustic sound-logging limiter in no case replaces the minimum insulation that the venue must have. They are two distinct and cumulative obligations. The acoustic study is what reveals the second.

«My electrician will install it»

The ordinance requires installation and calibration to be performed by technical staff or a company authorized by the manufacturer of the equipment. A limiter installed by an unauthorized party does not prove compliance.

The 12 features the limiter must comply with

Not just any device will do. The ordinance lists exactly what the equipment must do. If yours is missing even one, it does not comply. Santa Eulària, art. 23.1 (BOIB No. 62, 16/05/2026) ↗

  1. Funcionar como limitador de frecuencia en 1/3 de octava y como registrador sonoro.
  2. Permitir programar los valores límite de inmisión y disponer de pantalla para verlos.
  3. Micrófono externo calibrado con el equipo, capaz de detectar manipulaciones y verificable con sistema de calibración.
  4. Guardar historial con el día y la hora de las últimas programaciones.
  5. Almacenar en soporte estable, como mínimo un mes, los niveles sonoros y las manipulaciones, con periodicidad programable entre 5 y 15 minutos.
  6. Almacenar en memoria interna las manipulaciones del equipo musical y del propio limitador.
  7. Detectar otras fuentes sonoras que funcionen en paralelo.
  8. Disponer de sistema de precinto de conexiones y micrófono.
  9. Impedir la reproducción si el limitador se desconecta de la red eléctrica o del sensor.
  10. Permitir a los servicios municipales acceder al almacenamiento de registros.
  11. Permitir la transmisión telemática de los datos.
  12. Visualizador luminoso externo con el nivel sonoro instantáneo en dB(A).

Point 11 is the one almost nobody reads

The ordinance requires you to install equipment that telematically transmits its sound levels, holds you responsible for its proper operation, and allows the town council to extract historical data whenever it wants.

In other words: the law forces you to install a device that records evidence against you. The only relevant question is whether you read that log before the city council does.

What happens if you don't comply

General scale of Law 1/2007. Note: it is not the same in all municipalities — Formentera sets its own caps of 750, 1,500 and 3,000 € in its ordinance. Check your municipality's file.

But the fine is not what should concern you

Not having a limiter when required, or tampering with it, is grounds for urgent provisional measures: the city council can precautionarily close the premises before resolving the file.

You don't need to be formally penalized. It is enough for proceedings to be opened against you in July. The cost of compliance is known and budgetable. The cost of non-compliance is not billing for the season.
