The ordinance of Santa Eulària is already approved and published in the BOIB, establishing a transitional period of six months for existing activities to adapt. If your venue is d2 or d3 and does not have a recording limiter or acoustic study, consult us for the date applicable to your case.

What triggers the obligation here

Activities with d2 and d3 use under art. 5.2.02.3.d of the Normas Subsidiarias (art. 22.1). The Town Council may also require it for any other activity, planned or existing (art. 22.2).

What you need to know

  • Art. 22.3 — responsibility for correct operation and calibration lies with the operator of the activity, not the installer.
  • Art. 23.1.k — the limiter must allow telematic data transmission.
  • Art. 23.3 — installation and calibration must be carried out by a company authorized by the equipment manufacturer.
  • Art. 24.8 — under no circumstances does the limiter replace the minimum insulation of the premises.
  • DA 6ª — double doors with return spring, forced ventilation, and anti-vibration mounts in d2/d3 are mandatory.
  • DA 6ª — if emissions exceed 95 dB(A), a mandatory and visible sign warning of the risk of permanent hearing injury is required.
  • DA 4ª — ambient background music (<65 dB(A), without dancing) requires municipal authorization with a maximum validity of 1 year and negative administrative silence.

Adaptation period

The ordinance establishes a transitional period of six months for existing activities (Disposición transitoria única). Please consult us regarding the applicable date for your case.

What the limiter must comply with

  1. Function as a frequency limiter in 1/3 octave and as a sound recorder.
  2. Allow programming of the limit values for sound impact and provide a display to view them.
  3. External calibrated microphone with the equipment, capable of detecting manipulations and verifiable with a calibration system.
  4. Save history with the date and time of the last programming.
  5. Store on a stable medium, for a minimum of one month, the sound levels and manipulations, with a programmable periodicity between 5 and 15 minutes.
  6. Store in internal memory the manipulations of the musical equipment and of the limiter itself.
  7. Detect other sound sources operating in parallel.
  8. Have a locking system for connections and microphone.
  9. Prevent playback if the limiter is disconnected from the electrical network or from the sensor.
  10. Allow municipal services access to the record storage.
  11. Allow telematic transmission of data.
  12. External luminous display showing the instantaneous sound level in dB(A).

The actual setting of your limiter is not set by these caps, but by the actual acoustic insulation of your venue, which is what the acoustic study measures. These are the maximums that the ordinance does not allow to be exceeded in any case.
