BOIB núm. 169, 11/12/2014 · Consell Insular de Formentera ↗Formentera actively enforces sanctions: the BOIB contains multiple resolved sanctioning proceedings regarding noise issued by the Presidencia del Consell. The ordinance is adapted to Ley 1/2007 and RD 1367/2007.
What triggers the obligation here
Permanent TYPE 2 and TYPE 3 activities (arts. 42.6 and 43.6): required to install a sound level limiting and recording system with the characteristics of art. 44. In addition, the Consell may require it for outdoor activities and complementary musical entertainment (art. 41.3).
What you need to know
- Arts. 42.8 y 43.8 — under no circumstances does the limiter replace the minimum insulation of the establishment.
- Art. 43.5 — type 3 activities require double doors with return springs and hermetic closure.
- SEAL: in the event of any breakdown or replacement of the limiter or sound chain, UNSEALING must be requested from municipal services, followed by a NEW SEAL in order to resume musical activity.
- The final activity certificate must indicate the maximum acoustic power permitted by the installed limiter.
- Art. 44.1.k — the Consell may require telematic access to the limiter records.
- Annex VI — music and leisure activities on terraces or in the open air have their own specific regime, with open-window measurement.
- El Consell charges a municipal fee of 100 € for sound level measurement assistance.
- The amounts under this ordinance (750 / 1.500 / 3.000 €) are specific to it and do NOT coincide with the general scale of Ley 1/2007.

What the limiter must comply with
- Function as a frequency limiter in 1/3 octave and as a sound recorder.
- Allow programming of the limit values for sound impact and provide a display to view them.
- External calibrated microphone with the equipment, capable of detecting manipulations and verifiable with a calibration system.
- Save history with the date and time of the last programming.
- Store on a stable medium, for a minimum of one month, the sound levels and manipulations, with a programmable periodicity between 5 and 15 minutes.
- Store in internal memory the manipulations of the musical equipment and of the limiter itself.
- Detect other sound sources operating in parallel.
- Have a locking system for connections and microphone.
- Prevent playback if the limiter is disconnected from the electrical network or from the sensor.
- Allow municipal services access to the record storage.
- Allow telematic transmission of data.
- External luminous display showing the instantaneous sound level in dB(A).

Limits set by this ordinance
The actual setting of your limiter is not set by these caps, but by the actual acoustic insulation of your venue, which is what the acoustic study measures. These are the maximums that the ordinance does not allow to be exceeded in any case.

The fine amounts in Formentera are moderate, but the sanction is not the problem: the suspension of the municipal license, on an island with a short season, costs far more than any fine. And the Consell regularly resolves noise cases.
